Do you have to be read your Miranda Rights when you are being arrested for identity theft?

A person I know got arrested for identity theft and credit card fraud. She said they did not read her her rights nor have a warrant for her arrest but she went with the police on her own free will. She says her case will be thrown out due to those two facts. Will her case actually be thrown out, I mean the identity theft charge is a felony!
