How to report the custodial parent committing Child support fraud?

We recently found our daughter-I am the stepmother- had lived in Texas and Alabama with her boyfriend since 15. The mom would not tell us(did not know) where the daughter was and we couldn’t get a straight answer.

The prosecuting attorney would do nothing but tell me to tell the mom her checks are piling up downtown and that her prostitution job is ok, he even laughed. Now I am not a B***h, but come-on, enough is enough. read on.

The daughter is now 21, but he is still paying child support for several years we tried to fight with no help. So for three years that we are paying and they still take from his check and income tax return for this. The daughter also contacted the mom who told her she is not receiving child support, but we showed the daughter recent check stubs that prove she is receiving it.

The mom is on drugs and part of the time she was supposed to have the daughter, she spent 6 months in jail for marijuana and several different times for prostitution, which I have proof of. I have been at my wits end on this and pretty much given up, but its hard to swallow when I have been married ot him 17 years and he is still having to pay her child support for a daughter that did not live with her for the last three years they are making him pay for. Both the daughter and the father want it to stop. We have a good relationship with the daughter now and she tells me her mom is still on drugs.We would much prefer to give the daughter money if she needs it. We don’t want to get the mom arrested for fraud, but we want it to stop collecting what she don’t deserve and her out of our lives for good.

I dread filling out our taxes each year because I have to put injured spouse claim form just to get my part back when we should both get a check for what we overpaid.

So how do I end this? The prosecuting attorney is the states attorney who does nothing but fight to continue getting money for this mom who didn’t even know where that daughter was for the last three years he was required to pay this support. We paid to fight it in court and all they did was give him a paper stating how much she owed. We summons her to court and she didn’t show and nothing was done.
Our state is Florida, Jacksonville is where the case is held. We would love to have the money to afford an attorney, but unfortunately that’s not the case.I got laid off a few months ago and although I get unemployment, it’s not that much and my husband took a job making less than half the pay he was making building houses, but his insurance paid for back surgery last April.

The daughter still lives in Georgia with her new boyfriend. The guy she ran away with at 15 to Texas with is in Prison now. He was like 30 when she left with him. She said she had called her mom from a bus station and told her mom that she needed a place to stay or she was leaving. The mother said she could not stay with her , so the daughter left with this man to Texas. I see it as emancipating herself. We thought the daughter may have been with relatives and even the DCF wouldn’t check into it, nor the prosecuting attorney when I contacted him on several occasions.

purge of 00.00 each time, once when he was laid off and couldn’t pay. He got another job and was arrested when he got stopped on his lunch break for a cracked windshield. It was the day before my birthday.Another time he had accidentally shot himself with a nail gun in his knee, had surgery and got behind. When he went back to work (on crutches) and having been sick with pneumonia he was again arrested.We then set it up for them to just take it out of his check.

All these times,she did not live with the mom, she was in Texas with this guy and we knew nothing of her whereabouts until my oldest daughter working at a collection agency got her social security number from me and traced her to Texas, then Alabama/Georgia line where she lives today. My daughter contacted her through a number she got and put her in touch with her father. We tried as I said at one point filing papers to fight it and paid over 0.00 just for the paperwork and had the mom summons. She never showed up to co
court and my husband was given a piece of paper we could have paid .00 for from the court telling him how much he still owed. I’ve tried contacting the mayor and anyone I could. No one and nothing I have done has helped.

The mom will never be in our lives again because the daughter is grown and see the mom only when she comes to Florida now. There is no reason for the mom to be near us. The daughter just spoke with her father today. She calls him once a week or chats with me on Facebook as she started her own facebook to be close to us and keep in touch.

She loves her mom I am certain, but her mom is on drugs and doesn’t seem to car about anything but getting that money. Basically, we have been paying her rent for the past years and she gets his tax return money. We are simply sick of it. The age is 18 here unless the minor stays in school. His daughter was pulled from school at 15 and never attended another school. That’s another issue. If the child supports herself (emancipatio
(emancipation- found to be self supporting) child support shall cease. In this case it hasn’t.
