is this child support fraud?
on oct.2nd i went and filed a modification, for child support for my boys. i had given their dad many chances to be a part of their lives, but he chooses not to. he is married with 2 other children that are younger. he pays 106 for both boys a week. since i did the modification, they came up with a scheme, she filed a case against him, although they live together and he is the sole provider. he makes up to -100 an hour. is it possible for my kids to get screwed by what they are diong.

Child support is based on his income. Whatever she does or doesn’t do will not affect it. If he refuses to pay, the courts can have his wages garnished. You can look up a child support calculator for your area on the internet to see how much you are entitled to for each child.
If he tries to modify your support, then go to court and tell the judge what he is doing. Try to bring witnesses or other evidence that they live together.
what she does will not hurt your case, however put everything you do or say in writing, just in case
Possible. Since he’s effectively contesting the modification by claiming additional [pending] support payments, you have the option to expose the living arrangements. Support is for separate living arrangements, not common arrangement.
That would be like my wife and I each filing for child support from each other, just so we could reduce our individual incomes to qualify for government grants. How long do you think it would take for them to catch on and demand repayment? Well, maybe never, but if they did, it could be real expensive. And that’s why I said, possibly.
By the way, the IRS didn’t buy it either, when it was cheaper for us to file separately on taxes, but she claimed 0 exemptions, and I claimed all of them.
$106 for 2 boys from a guy that makes $70 an hour is insanely low.
