The only way to know that would be if she knew she had not slept with you. If there was a reasonable chance that you were, she had a right to make that claim.

There is a big difference between a mistake and a fraud.

How is it hurting you that the child is collecting SS benefits? They will sort it out, the person you spoke with obviously does not understand the system (not that uncommon), but it will be straightened out.

You should have a contact number and a case record. I would definitely follow up, continue to follow up and by all means make sure that any back payments that are coming to you are applied. By the way, a recent CNN article reveals that millions have been paid to people who are legally classified as deceased, with all of the fiscal repositioning occurring in todays government I would not be surprised if major social security reform is next on the list. Contact your office, only they can work through this.

It may be that SS has established that the child was already your dependent. Paternity is irrelevant.

P.S. If you live in Texas, If you are married to the mother or paying support you have until the child’s 4th birthday to dispute paternity. After that it is to late.

How is this going to affect your Social Security Disability payments, especially IF they are or become permanent!? Why should you be held responsible for this child until he or she is 18? You can bet your life, if YOU were one trying to defraud the government and the tax payers, they would wipe you right out of that system of theirs in a heart beat! Go get these morons.. It is too easy for them to fluff off a voice, but when flesh and blood walks through the door, they have to take notice! One thing though, stay cool,but have all your documentation with you, AND anything you can find in the law books on this scenario! This is an example of how lazy some of these Government workers are! They would rather pay up, than get off their buuts and do a little leg work! Same thing with the Welfare Department! The only time they come out of the woodwork is when a poor kid is found dead, just because they failed to check up on them on a regular basis!!!
