how hard is it to convict someone of credit card fraud or identity theft?
my nephew charged 12,000 on to my discover card and i didnt see the statements they just took 2 payments out of my checking account..
now im trying to dispute that charges.have i waited too long ? the last charge was in july of last year.
i called discover and they said that they would send me a new card and investigate and call me back in 5 days..so what will happen next i should say can anyone guess
he did have contact with discover card and did talk as me to stall the payments.
so do i have to press charges against him in a civil case or will the card press charges and have him arrested
i have talked to him and he has argred to make the payment every month but now that i have had discover investigate is it too late to stop charges from being filed?
and if i do file a police report will it be long before he is arrested?

What kind of lawyer will I need to file a lawsuit against PayPal for unauthorized charges to my debit card/checking account???
(Don’t have credit/credit cards so there goes my protection…)
Their business tactics are very deceptive.
They purposely hide contact information and are always "temporarily unavailable" meanwhile charging for things you didn’t purchase!
I have had all I am willing to take!
I will be sueing them for fraud and emotional distress!
I would prefer a non profit lawyer if available seeing as how the idiots at PayPal are charging me down to my last .
I tried to dispute the transactions and guess what? Error message page! Of course! Yet another money-stealing tactic!
I will be removing my info as soon as possible and never using their services again. Just tell me what kind of lawyer I need!

Hello. long story short, my husbands checking account was in the red due to identity theft. We went through all we had to with the fraud dept at our bank. They went and took my child support that is electronically deposited into my account weekly. Does anyone know if it illegal to offset with child support. I was under the impression that it was illegal to touch child support to satisfy any arrears. Any help or advice would be greatly appreciated as I am fighting a losing battle with the bank. Thanks

I’m trying to rent a house and on the application it asks me for my name, social security, current address, employer etc..
Here’s the scary part, it asks me for my checking account number and routing number. And the bank accounts I have. Is this a scam? or is it normal for rental applications?
I figured this could be a huge identity theft scam were they put up a house for rent, then make this type of application to get bank information on careless applicants or first time renters who dont know anything about a standard housing application.

I had been on medicaid but I won my malpractice suit and so I took myself off of all gov. help when I realized that the insurance co that was suppose to help pay my medical expenses was not the real thing I had been cheated out of over 00. The co. say I never let them know I had canceled when I did and they continue to take my money from my checking account. Now I am without the money and back on medicaid. I have over ,000 in medical bills and I have paid the biggest part of them out of my pocket. I still owe doctors, hospital and radiologist around 00. Is there anyone that I can contact about this matter or should I retain a lawyer?

To make a long story short, I had a merchant credit card processing account setup through the original creditor, Cardservice International, approximately 4 years ago. During that time I only made a few charges using the account. They were large charges and totaled just over ,000 altogether. These charges were never deposited into my bank account and I was contacted by a man working with their fraud management department. He wanted me to send out products before receiving the funds so I did not agree and I stopped using the merchant account. I also contacted my bank to block their access to my checking account.
Now they have hired the collection agency Allen & Associates on their behalf to collect the ,000 that they never gave me in the first place! I’ve obtained former bank statements from Wachovia and spoken to a branch manager. I attempted to send this information to Allen & Associates, but the agent on the phone refused to provide me with a fax number where I could send documents to dispute this debt and told me that I should just get an attorney because they will sue me. They did "claim" that a representative from Wachovia will be present to testify that the deposits were made so tomorrow I plan to bring the list of supposed deposits into a branch to get a certified letter from a branch manager stating that they were not. This invalid debt for ,000 is also on my credit report as of right now. I’ve disputed it and it was removed at one point, but it appears that A&A has reported it again.
I need to legal advice on how to proceed. I’ve tried to dispute the debt, but obviously they will not allow me to even show them the documentation I have to support my claims. If I do file a suit against them do I file against the CA or the original creditor?

Last July, I attended a trade show to sell and promote my products. I processed credit cards manually and made a mistake w/ one transaction and over charged a customer by . She called my attention after she received her bill and I profusely apologized for the mistake. We both agreed that I will I send her a check for the refund. Then in October, my checking account had been breached and the bank closed it. I transfered my account to another bank. Yesterday, Nov. 2, this lady called me, extremely irrate, threatening to ruin my business' reputation. She said she tried to cash my check JUST YESTERDAY and of course it bounced! I explained what happened and offered to send her another check but she's demanding that I pay her the bank surcharge and interests. Should I be responsible for this? I mean, I understand that I made a mistake…..but wait for 2 months before cashing a check and now demanding that I pay interests and surcharges ?! Does this make sense to anyone?!

My fiancé took out a 0,000 life insurance policy when I became pregnant.
He appointed me the sole recipient of the funds if (Heaven forbid) anything were to happen to him. He has no other living family besides his brother who, coincidentally, is my fiancé's life insurance agent.
His brother is a sleaze (neglected their sick elderly father for years, wrote himself checks for large amounts of money from his disabled father's checking account, etc.), but my fiancé wanted to help him out by supporting his account base and need life insurance for himself to secure myself and the baby financially in the case of a crisis. He is otherwise estranged from him.
When my fiancé requested a copy of the insurance forms, we noticed that his brother had written in (in his own handwriting – obviously not my fiancé's) himself as the contingent when no contingent was assigned in the original agreement.
My fiancé contacted his Supervisor, but is this insurance fraud? Will his brother lose his job? Do we have any legal standing? What he did was wrong.
Any advice?

I had a checking account at a bank and my friends kids were listed as Payble On Death. The account overdrew some 0 and they charged it off. It was due to fraud and I'm still fighting it. My friends took their kids there to open an account and they were listed as co-owners of the account. I signed them up as POD not as joint owners. The bank siezed their sons money and was going to do the same to the daughter but they caught it in time. They were told they had to file a police report against me for Identity Theft. I didn't steal anything. They were listed as payable on death not joint owners. Can they legally do this? Change the childrens status on the account and seize thier money. We are going there tomorrow to try and straighten things out. Should I bring a lawyer? Help I'm really stressed about this!
