EBAY FRAUD, LOST 700 DOLLARS PLEASE HELP?

hi i bought 14 items from lolita4321 on ebay.com, i gave her my measurements. She sent all 14 items 2 months later, i received the items on the deadline for feedback and dispute resolution. I had begged her to send it even at that date because she said i was being hasty?! I told her it has already been 2 months. She sent them. ALL SIZES COMPLETELY WRONG, 10 times bigger than me, zippers broken, items made not as described.
So then i told her this and she played dumb and kept saying send the pictures. At first i was so upset and i did not send any pictures, she offered me ONLY 100 dollars and i paid her 700 dollars!! Then i filed a dispute and claim with ebay and paypal. Paypal dropped the claim saying they do not deal with "Not as described items" Then i had filed a claim with Econsumer.gov. I finally gave up and took a picture and used a standard size dress that fits and placed it on the floor next to the dress she made. It was 10 times bigger, she emailed me back saying I AM LYING, that is a CHILDS DRESS NOT MINE. Then i wore it and showed it to her. Now she believed me then she refused to help me saying she is going on vacation, bye!
and that was it, please anyone help me. i have sold over 368 items on ebay and have 100% positive feedback. This seller sells LOLITA dress from CHINA and i have noticed if she does get negative feedback it dissapears in a couple of days, it gets revised. Which is NOT possible.
Where can i get a lawyer, i lost 700 dollars and she is out vacationing, she could care less. And yes i have emailed the ebay trust and safety team several times and also filed claims there. Please help me anyone!!
To shiori, i paid using my checking account through paypal and the dispute i opened had only two options, not shipped or not as described. I picked not as described and they dropped the claim saying it has been more than 45 days since she took more than 60 days to send and also they said they do not cover NOT AS DESCRIBED items. The seller is out vacationing, i tried to negotiate she blew me off saying its the weekend so whatever.

I need some legal advice, please?

Okay…I have a little situation that I need some advice for… I signed up to work selling for a dropshipper…Basically, he had a website with some items on it, I got on eBay and listed the items. When they sell, people payed me through Paypal and I would pay the dropshipper, give him the names and addresses and then he would take it from there. He has a warehouse in the US that he uses to store the items.

Well, recently, he had added some ‘larger’ items that would bring in more profit. One in particular was a set of Rosetta Stone software. I would list it at about 0 and I bought it from the drop shipper for about 0.

Well, I sold about 30 in a week’s time. Now, the problem is, eBay cancelled all my auctions and kicked me off eBay. They also took the liberty of emailing all my customers and telling them that it was fraudulent and that they all needed to call the police, fraud department, and even the FBI!!!

I called my drop shipper and asked him what was going on and why they would do that. I even asked him if they were pirated materials (since one of the customers told me that he had gotten a pirated copy) He won’t answer me and tell me whether or not they are fakes. He just keeps telling me that I will win all the disputes on Paypal (since people were getting a little suspicious since I was ‘no longer a registered user’ on eBay) since they are non-reciepts. That’s not the issue…if these are pirated materials, I am in big trouble for selling them!!

Another issue, is these are coming from China. I just assumed since they were from him, he would have them in his warehouse in the US.
Now, I’m not really sure what to do because, if in fact these are pirated, I could be in a whole lot of legal trouble.

Another thing, is if he refunds the money on these, he will only refund what I paid him for. The problem with this is, I had to pay a lot of eBay fees and Paypal fees so, I would be out probably close to for each sale. times 30 is….a LOT!!

I need to know what steps I should take to protect myself! Any advice would be very helpful! Thanks!

General statements regarding the quality of Chinese goods have forced Americans took look yet again at the ‘made in China’ tags on their purchases. Why are Chinese goods still so cheap, even after nearly a century of market development in the US? Prices are so low a saying of old wisdom comes to mind – If it looks to good to be true, it probably isn’t. Just a question, but if you were a wealthy criminal, wouldn’t ‘made in China’ tags be the best way to launder your money?
