credit card fraud help please?

Ok about for yrs ago I got arrested by my mother I was locked up for a month. While I was locked up my mother filled out an online form for a Capital one card in my name, I didn’t find out till about a yr later.. Some she used the address we lived at the time been trying to fight this for some time now I got a letter from a local lawyer to go to court I fought that and he dismissedt. I tryed calling eqifax,capital one and they can do anything i get no help.. this is on my credit report and want it off a/s/a/p i would file a police report on my mom but fell bad cause shes homeless now. But any help here with this my credit is shot cause of her and i want to buy a house soon.. thank you…

‘ve try to apply for student credit cards and I a job. Yet I don’t get approved and i know people who don’t work and get a student credit card. I tried to do a credit report and they won’t give me any info because there might be fraud or something.

Serious Legal Question on WAMU Credit Card?

JPMorgan Chase said it was not acquiring any senior unsecured debt, subordinated debt, and preferred stock of WaMu’s banks, or any assets or liabilities of the holding company, Washington Mutual Inc. JPMorgan also said it will not take on the lawsuits facing the holding company.

Now, if there is no signed credit card agreement between me and I also loss stock in WM, can I dispute my credit card debt? The problem is WAMU screwed up my account and gave me a card over the phone based on an equity loan that had been closed for over a year. When they found out the mistake, they demanded payment in full. I disputed and asked them to simply transfer to a new account and send me a credit card agreement at the same interest rate. They refused and rather then work to resolve the issue, they threatened me with fraud.

I had to retain a criminal attorney which cost almost 10K to prove the error on their part, which they eventually admitted to. However, the stress was so much that I had a heart attack and was hospitalized. So we where in the process of filing a lawsuite against WAMU for what happened and what I have suffered as they refuse to remove the dispute from my credit report.

Since then I had to retain a credit attorney (who is off today – but I did leave his office a voice mail ) and I want to know if whoever holds the new debt, if they can’t prove the debt was agreed upon or there was no valid contract, can they uphold the debt and if so, can I then take the legal action against them for what I suffered?

Someone got a hold of my husbands name, address and SSN and opened a fraudulent account with Sprint. They racked up over ,000.00 in charges and now a collection agency is after us. It is also on our credit report. Help!!!!!

I payed all my child support owed to my ex. My child is emancipated and 19 years old and working. I owe arrears because of the interest that accumulated, when I was sick and in the hospital for awhile and she went on welfare. So they billed my K for this about a year ago. And no, they don’t care if I was in the hospital almost dying. And no, I could not get a loan to pay it off in a lump sum, because they added this debt to my credit report, and no one will give me a loan. It is pure interest only. Although they still call it child support. It is collected by the DA for the mother.

We made a written agreement which is signed, and she accepted and deposited money from me per our new agreement, I have copies of checks. she notified the DA to close the case. They did, then she asked them two months later, to reopen the case that she did not agree to any separate contract and did not sign the contract.

The DA never stopped garnishing my pay check between this period, so she got twice the amount of money from me. She basically pulled a fraud on me. I have tried contacted her and she refuses to communicate with me.

Can I sue her is civil court for the breach and fraud, and basic remedies? Or will the civil courts kick me back to the DA to resolve because the monies is still, "child support".

The DA told me that there is a way to close and have the court validate this separate agreement. Then they said this was wrong that they are not actually attorneys representing my ex, and cannot be legally involved as a third party to a separate agreement. They said the mother has the "FINAL and Absolute" power to open or close the case.

This case is in California. It honors separate agreements. I have another child a couple of yrs. older. I worked out a separate agreement with the DA in a separate county and they honored it and closed the case.

If it is not a civil case then, lack of due process is prohibited. Which means, there is no means for me to seek justice, like everyone else in the country. which is discrimination. So, I know that is not the case.
I am sorry people, I know this is a complex question. I was hoping to find someone who actually experienced such a matter.
Near death is not the same as being dead. In a court of law there is a definite separation. As a matter of child support law in california, you either are decapitated, in which the court will need a motion and a doctors report. And they will only lower the order temporary, and it will still collect interest. And if you are dead, then they sue your estate, ( insurance company). They have thought of all avenues.

Please no answer from bitter single moms, or father who got divorced before 1983, or single guys who do not have a clue about the system.

I am under 18 years old and I have things on my credit report. When I call the companies and say fraud they act like they don’t know what I’m are talking about. I live in Minneapolis, MN and need some assistance on how to get them off all at once. It should be a way where I don”t have to pay a lawyer. child support not helping the child?

my mother started to receive child support payments after my sis and i turned 18 about 900 a month. My mother has been married 7 times and was physically and emotionally abusive to us as we were growing up. I ran away and moved out at 16 and my sis married at 17. Now she is getting this money from my father who i just met online and spending it on my cousin and herself. I had to drop out of college because my place of employment closed and i had no way to take care of the tuition. yes i had financial aid before but it can only take care of basics right now. if i would like to continue my education i would have a doosey of a time while my mom sits back and collects a check every month. I started babysitting at 14 and from then on until i left i had to pay my mom rent to live there. she would charge us for tampons and anything we ever broke as children, bills, thats why we left so early. is it fair that my neglectful mother now just cashes checks? I was afraid most if not all of my life and it is not until now that i feel that she should be obligated to help my sis and i out. i have school loans i am struggling with and she has not given us a penny of what my father has been paying her. it is not fair. There has to be a way to have the payments sent to us and not her because she is just squandering the money instead of helping us. not that i would ever expect my mother to help, she has stolen thousands of dollars from me in different scams. there are even discrepancies on my credit report from her old addresses. how can i report fraud on my mother… i cant be the poor victim anymore and take one thing away from my mother and that is her spite and vindictiveness. please let me know if there is anything i can do. i have seen online other cases where the support is granted to the children. I cant stand to see her squander that money on booze and friends and even my cousin who wants to hang out with her. I am stuck and would love a response.

fraud with social security number help!!!!?

im 15 years old and im pretty sure that someone used my social security munber for there bills. Now i cant get my vredit report to find out for sure if they did anything until im 18 without getting a lawyer and as you all no that can be very expensive. Is there anyway for me to figure out if they did use it or do i have to wait?
my parents did look into it and apparently they still can’t find anything our until im 18…. i kinda want to do something about it now….
the only thing is i can’t be sure until i get my credit report and i can’t do that until im 18
It’s because my biological father used it and we no becuase when he called my name came up instead of his own… and he has a past of doing this to my sibling and stuff

i recently found out that some one stole my identity when I was 14 years old; they bought a house and god knows how many other things, now I went to the SSA and they told me to ask for a credit report and dispute what’s not mine. but I can’t get one because I need to provide them with information about ” my loans” which obviously I don’t know anything about. so I need help as of what to do. thanks in advance.

Legal Advice on owing money to the collecters?

My roommate needs legal advice I don’t know how to help her, she owes a check cashing store 299. dollars which went to collections and they called saying it went to some Fraud depart and there going to open a case, does that mean she going to get a warrant or arrested or just a bad credit report to the credit bureau, how can I help her? car lease not on credit report?

So, my lease broker committed fraud on my lease – my attorney can’t do anything on contingency after 12months of trying – the broker said they will fold to avoid paying, etc etc LONG story – SO, the as car doesn’t show on my credit report – if I stop paying, what can they do apart from just take the car back? Can’t I just fight the repo on my credit as fraud, just like the initial entry (which I disputed and won) They don’t even have my SSN linked to my account when I call the Lienholder……

I am currently disputing a claim that I am a co-debtor. I was an authorized user on my ex-wifes credit card and could not have my name removed from the account, because I am not the primary account holder. I have not received any gain from the use of the card. Regardless, it is on my credit report and I have been trying to resolve this issue with the credit collection agency. They suggested I file a fraud affidavid. I recently found out that my ex’s bankrupcy will go into affect in two months. Will I be held liable for paying the debt even though I was an authorized user? Should I still file the fraud affidavid with the Federal Trade Commission even though she explained to me that her lawyer was taking care of the co-debt situation?

Need legal advice fast!!!?

About 6/7 months ago I received a phone call from a credit collector. I had no idea what the person was talking about and when we figured out the reason behind this, it came to be that my own mother had stolen my identity.

Apparently, she had opened up a credit card, racked up 00, and never paid it off. After this phone call I proceeded to run a credit report for myself and come to find out "I" am 00 in debt because of the car loans, credit loans, house loans that my mother opened up on behalf of MY credit – using MY social security number.

I confronted my mother about this, she admitted it was when she was using drugs.

Long story short, my mother has been off drugs for a while and we’ve come to a good point in our relationship. The problem is, what am I supposed to do? I can’t go around with this credit as credit is everything: to get a car, a house…

She has already been to jail twice for fraud… and I know that if I were to tell credit collectors or any say it wasn’t me, she would end up going back to jail – prison probably. Which, I am NOT up for doing. I just had her first grandchild and I’d like her to be here, not behind bars.

Everyone keeps telling me it is not my problem, that she made the mistake, even my own sister tells me this – but could you put YOUR own mother in jail?

I couldn’t have even done these loans as I was only 14 and younger when this all took place (I am 19 now).

Who do I call? Lawyers? What would I say?
I’m trying to call local lawyers to get their advice but get tongue-tied when I try to explain what I am calling for in the first place. I don’t know how to start the conversation….

WHAT do I do…? What would you do in this situation?

warrant in my name! but i didn’t do it!! lawyer?

found out there is a warrant out for felony misuse of credit card for me in ohio, however, i have never lived there, been there, nor do i know anyone that lives there. i definitely didnt do the crime!!!! called and was confirmed that a warrant is in my name, however i talked to someone about how it is ID theft, and how i have proof of living in a totally different state, in another part of the country. some secretary told me that i need to come there and turn myself in, but when i talked to someone else they told me to just talk to someone in fraud/theft and they will try to straighten it out so i wouldnt have to (live in louisiana). i am also pregnant, so i don’t want to go there and have to go to jail since i am almost 7 months along!! scared out of my mind!! should i just go to a lawyer and see what (s)he can do??? not sure where to go. filed a report with ftc.gov and fraud alerts. should i have to turn myself in when i didnt do it??
i did place fraud alerts on my credit report (got one after i found out about the warrant). and found 2 address in ohio, i’ve never lived there nor know anyone who has. and am working on getting that straight too…. worried because i dont want to go to jail when i didn’t do anything wrong, esp that!!!! not because i did it!

social security (possible fraud) question?

hi, my friend is 17, and her wallet was stolen a few years back with her ss card. she is now afraid that people have used her #, but not sure what to do. we told her to go to the ss office and get a credit report. but what if someone had used her card, what would her actions be? she is now applying to college too, would that hinder anything?

Help! Social Security fraud Im only 17?!!!?

I have recently discoverd that some one else is using my social sucurity number dating back to a revolving account in 2002! My bag was stolen last summer. Im only 17 years old. They have also have a morgage dating january of 2005 and a car loan dating july of 2006. I recently applied for a card to build my credit and they are saying that my name and number do not match or they have been changed what do I do?

I’ve heard that identity theives even steal teen’s identities making their credit bad without them realizing. I am a concered teen worried if my credit score is bad and/or somebody has stolen my identity. I’ve been to several credit report websites and am unable to find one that allows people under 18. Do you know of a website to solve either of my questions?

Identity Theft???

I pulled my credit report through a company called Identity Guard and in it it contains background information and according to that I was arrested and charged for drug posession a felony in the state of Arkansas I have never even been to Arkansas and that definately was not me I live in Ohio. I dont know what to do to find out if this is a mistake on the part of Identity Guard or if someone has stolen my Identity. I called Identity Guard but am just getting the run around from them and my local police department will not help me until I can prove this is really listed under my social. I am going for a great job interview on Saturday and am afraid I wont even be called back If this does show up on my background check. Arkansas is not a public information state and they want you to pay for everything. I dont know where to begin Please Help!!!

My ex-wife gave someone else enough information to pull my credit report, on her behalf, through the service freecreditreport.com. FCR sent me a notice in the mail, which is how I found out about it. I already have gone into my account to change passwords, etc… and shut down access.

The issue is this. She did this in 2005, when we were going through our divorce. I challenged her on it and she claimed she had a guy friend who was a Private Investigator and he must have done it in his zeal to help her. This time, she denies having anything to do with it. However, you need to know a lot about a person’s credit history to gain such access.

What is interesting this time is that they used a Discover card to gain credit authorization to check my credit report. This is good as I have an electronic record of the breach.

But my ultimate question has to do with government reporting. My guess is that accessing someone else’s credit is a serious crime. Since I have already given my ex a Get-Out-Of-Jail free card on this exact matter, I’m of a mind to defend my information to the fullest extent possible this time around. Therefore, I need to know to whom I can report the breach of this information.

Can I check my child’s credit report?

I know I can check my own credit report once a year for free by going to annualcreditreport.com or by going to each company’s website. However, I keep hearing that I should monitor my children’s credit reports for fraud and ID theft too. How do I check theirs legally?
