EBAY FRAUD, LOST 700 DOLLARS PLEASE HELP?

hi i bought 14 items from lolita4321 on ebay.com, i gave her my measurements. She sent all 14 items 2 months later, i received the items on the deadline for feedback and dispute resolution. I had begged her to send it even at that date because she said i was being hasty?! I told her it has already been 2 months. She sent them. ALL SIZES COMPLETELY WRONG, 10 times bigger than me, zippers broken, items made not as described.
So then i told her this and she played dumb and kept saying send the pictures. At first i was so upset and i did not send any pictures, she offered me ONLY 100 dollars and i paid her 700 dollars!! Then i filed a dispute and claim with ebay and paypal. Paypal dropped the claim saying they do not deal with "Not as described items" Then i had filed a claim with Econsumer.gov. I finally gave up and took a picture and used a standard size dress that fits and placed it on the floor next to the dress she made. It was 10 times bigger, she emailed me back saying I AM LYING, that is a CHILDS DRESS NOT MINE. Then i wore it and showed it to her. Now she believed me then she refused to help me saying she is going on vacation, bye!
and that was it, please anyone help me. i have sold over 368 items on ebay and have 100% positive feedback. This seller sells LOLITA dress from CHINA and i have noticed if she does get negative feedback it dissapears in a couple of days, it gets revised. Which is NOT possible.
Where can i get a lawyer, i lost 700 dollars and she is out vacationing, she could care less. And yes i have emailed the ebay trust and safety team several times and also filed claims there. Please help me anyone!!
To shiori, i paid using my checking account through paypal and the dispute i opened had only two options, not shipped or not as described. I picked not as described and they dropped the claim saying it has been more than 45 days since she took more than 60 days to send and also they said they do not cover NOT AS DESCRIBED items. The seller is out vacationing, i tried to negotiate she blew me off saying its the weekend so whatever.

Possible Options for Ebay Fraud?

I was selling an item on ebay a while ago and the day that it was ending someone bought it "buy it now". They then requested my contact info thru ebay and called me about 12 times consistently, leaving me messages to call him back about the item. He also sent me ebay messages. I called him back and he explained that he would like me to overnight the item due to an urgent need to use it. He said that he would send the money out that day as well. Now, being a trader on some other forums that sell the same item (archery-bow), I’ve never had a problem with doing an even trade. Tracking number for the item, in exchange for tracking number of payment. I’ve never had any problems and after talking for almost 45min with this guy, he seemed to know his stuff and seemed legit.
So after some thought, I agreed and sent it..overnight with a tracking number.
It has now been well over a month and I still have no payment.
In most situations like this, you lose contact with the scam buyer:no response to emails or phone calls: but that’s the odd part. I have his phone number, address, ebay username and history, multiple emails, AND he still answers the phone and talks with me every time I call to inquire about where the hell my money is.
He originally told me that he was having trouble with his paypal account and therefore would send me a money order: never received it. He told me so many times that he was "done with ebay", "all his accounts had been locked up", he was "getting his lawyer involved", he even gave me a number that was supposedly the lawyers’.
I have spoken with him in the past week and when I told him that I still have seen no payment, he tells me that he will check it out and call me back. I receive no follow up call.
I just want my money or the item back. Oh and his feedback on ebay, is 100%. No one said anything about nonpayment. So why me?
What are my options? Can i get a lawyer to help me out? Get the police involved? Anything?

A friend of mine here in Mobile was taken for ,999 in a very clever scam that involved not just spoofing but the highjacking of another eBay member’s account. I contacted eBay and they will not refund the money because they call it ALL spoofing which they do not cover. My research is indicating this is a major, major problem. Please don’t reply that people deserve to get ripped off if they don’t follow ALL the ebay "guidelines." Some people are young and new to eBay and the Internet and there are apparently not enough warnings on the eBay pages, like graphic images flashing and warning people about the severity of the scams. When a member’s account is highjacked and you have no way of knowing it as a customer then you think you are dealing with a legitimate auction. Any experience, you, family or friends?

Is this worth starting a mail fraud case over…?

Okay I sold a brand new pair of shoes on eBay for shipped. I sent them with tracking and they showed delivered to the buyer on august 5th. They told me they never received the package however. Saturday august 8th rolls around and they tell me they got the package but instead of getting the new shoe they bought, they got an old dirty used pair. They came up with a bogus story and said maybe their neghbors took the package an replaced the shoes or maybe the postal worker did. Of course they opened a claim with paypal and got a refund. My question is this: is it worth trying to get a mail fraud case against this person for a pair of shoes or not? Also, would I have to get a lawyer or attorney or something to be on my side or could I handle it all myself? If the law requires I do have someone to represeent me, who would it be in the law field(ex lawyer or atorney)? If it helps, I live in Ohio and they live in TN. Thanks and please help ASAP.

Ebay FRAUD! Are their lawyers out there for this?

I purchased a car nearly 7 weeks ago for 00.00. I paid by check and the seller cashed my check. I have a copy of it with his signature from the bank. I have been in contact with the seller and he kept telling me the title was going to be FedEx to me. First the seller had to wait 10 days for the check to clear he said before sending the title then he said he sent it but it was a weekend… then he said the car had to go through an inspection to be shipped to me… I am in Michigan and he is in Maryland. Next he said he hadn’t shipped the title so I could get insurance on it…. he basically gave me the run around for 30 days and after 30 days you are NO LONGER eligible for the Ebay Motor Sales Insurance. This I found out afterwards. NOTE: He has my money and my car… I have contacted Ebay. I have filed formal complaints with the Ebay People and they say all they can do is suspend him?????? This is crap in my eyes. It has now been 7 weeks plus. I have contacted ..
I have contacted local athorities here and have the police working on it but they say their hands are tied too. No jurisdiction since the crime took place in Maryland and not here. Maryland police tell me the crime took place here. How can that be???? I just want my car or my money. Isn’t this a FELONY on the sellers part???? And ebay doesnt care???? I thought ebay protected people. It would be different if they said they couldnt help me if I had received my car but I did NOT receive the car and the seller has my 00.00 – HELP ME! Who can I call next??????
"Uncle Jed Knows" – so are you telling me that there are millions of buyers daily on ebay that are STUPID? Transactions take place every second on ebay and millions of auctions end daily. They sell cars every single day. It was NOT underpriced the car I bought and I was not the only bidder. Maybe I was stupid to buy from a person with numerous sells and 100% feedback but paying first is the ebay rules. I wish there was another way around it too, but that is how they set up the auction. I still have a hard time believing that there is nothing ebay can do for me or others that find themselves in this situation. I will continue to search to find answers and I will take suggestions people give me here also. I am sick over my loss of money and it’s not a drop in the bucket to me. I work hard and I am a believer that I have ‘Rights’ in this world.

I need some legal advice, please?

Okay…I have a little situation that I need some advice for… I signed up to work selling for a dropshipper…Basically, he had a website with some items on it, I got on eBay and listed the items. When they sell, people payed me through Paypal and I would pay the dropshipper, give him the names and addresses and then he would take it from there. He has a warehouse in the US that he uses to store the items.

Well, recently, he had added some ‘larger’ items that would bring in more profit. One in particular was a set of Rosetta Stone software. I would list it at about 0 and I bought it from the drop shipper for about 0.

Well, I sold about 30 in a week’s time. Now, the problem is, eBay cancelled all my auctions and kicked me off eBay. They also took the liberty of emailing all my customers and telling them that it was fraudulent and that they all needed to call the police, fraud department, and even the FBI!!!

I called my drop shipper and asked him what was going on and why they would do that. I even asked him if they were pirated materials (since one of the customers told me that he had gotten a pirated copy) He won’t answer me and tell me whether or not they are fakes. He just keeps telling me that I will win all the disputes on Paypal (since people were getting a little suspicious since I was ‘no longer a registered user’ on eBay) since they are non-reciepts. That’s not the issue…if these are pirated materials, I am in big trouble for selling them!!

Another issue, is these are coming from China. I just assumed since they were from him, he would have them in his warehouse in the US.
Now, I’m not really sure what to do because, if in fact these are pirated, I could be in a whole lot of legal trouble.

Another thing, is if he refunds the money on these, he will only refund what I paid him for. The problem with this is, I had to pay a lot of eBay fees and Paypal fees so, I would be out probably close to for each sale. times 30 is….a LOT!!

I need to know what steps I should take to protect myself! Any advice would be very helpful! Thanks!

After filing a compliant with the DMV of Fl, I was informed by the investigating office that the dealer tampered with the O/D. The original miles on the car was 163,688 mile, at time of purchase the miles on the O/D was and still is 102,898 (O/D broken). I start suspecting O/D fraud, when I notice that the O/D was not working (not counting the miles).

The dealer called me and asked me if I wanted to return the car for a full refund or if I bring the car they will fix the O/D. I am not stupid they are afraid because they got caught. The dealer knows that what they did is illegal and now they are tying to "sugar coat me" because I am a girl. I am going to sue those bastards. I need to know if anyone can refer me to a lawyer in Dade county Flordia that handles these type of cases. I also want to know what is the max amount of money I can sue those thugs for. The car is a 1997 ford mustang. The car is super nice.I bought it off the ebay web site as a "buy now option.

China scam me and Revenge against China?

On June 26th 2007, I am planning to make business online to get product from china to sell on ebay, I find the website into China www.cnmall-online.com and talk with this man to ask if it have product of Sony Laptop
so this man says yes and it alone 360$ plus shipping 20$ total is 380$.. so this china man wants used western Union for make payment… so I never used WU before.. So i did sent my money 380$ to him.. He says he got it then gave me fake tracking number for shipping, so I am wait for item over 6 day because the china man says i will receive 2 to 3 day, so I email him again, then he says HAHAHA then block me, then I told him I want my money back! He says I am not man… a woman! I was very upset and devastate for 4 month ago, i already told my dad about what happen.. He says Mostly women in china are scammer and there nothing get money back or report because OVERSEA cant reach of police there to arrest that china woman.. will I get revenge get money from china use WU?

I sold some speakers on Ebay to someone in Argentina, even though my auction stated canada or us. They won the auction, and paid me via paypal. I then shipped the speakers. Sounds easy.

THEN, a week later I received a notice from paypal that the user filed an "unauthorized transaction" with their credit card company. So paypal charged the funds BACK to me !

Now I am out the speakers and the money. I dont feel that paypal is making a very fair decision. They state it may take that persons credit card company 75 days to get to a final decision, but paypal wants their money in 7 days?

Does this sound right to anyone? I need some advice, paypal is being totally unreasonable.
After receiving the chargeback notice, I went to Ebay and the user that won the speakers was no longer registered.

I am a Ebay Seller that selles Cell Phone & Aceessories. I don’t use paypal, but a credit card merchant acct. Recently my merchant acct got suspended for 180 days. Caused of suspension? increase of voulme and high risk product. Now, my acct has been suspended for about 2 weeks. In the mean time, I was still selling cell phones because they first told me that it was just a small review, so I thought everything would be okay. I have all the accessories in stock cos I bought them at a close out. But for an actual cell phone, I used a dropper shipper. Now, I have already spent all my lifetime saving to have those cell phone orders shipped out without any money being returned for another 180 days. But I am now out of my savings already. In fact, I am even getting kicked out of my apartment, too, cos I didn’t pay my rent but to ship phones. Now, I still have 40 customer’s order not shipped. They are going crazy at me~ what can I do? Even my bank acct is overdrawn. Am I committing a Fraud?
To people who are answering my question! I did not take people’s money. My Credit Card merchant never released the funds to me. They have the money and won’t return it for another 180 days because they suspended my account. I used a drop shipper, so normally once I recieved my customer’s money, I will send it over to my vendor and have them ship out the goods. But after they have suspended my merchant acct, I stop recieving money. So I have been shipping goods to my customers without any money depositing to my account. I was using my lifetime saving to ship to goods out. But now I am so broke & have no more money to ship the items. That’s why I am asking if I have committed a fraud if I can’t ship. Cos my merchant told me that it is my responsibility to have the goods shipped even if my merchant acct is suspended. But I am like "but I have never even recieved any funds from the purchase" Well, I did, I used my savings and shipped until I am now broke. Do I go to jail next?

I signed up for a credit card merchant account, but not Paypal! Many years ago, I was only 18 yrs old. I have sold some of my own Clothes, Nikes, Playstation 2, DVDs and Games using Ebay via Paypal. For no reason in particular, Paypal at that time had suspended my account and had my funds frozen. The information they wanted from me was unobtainable, such as invoices for the merchandise I was selling which was difficult since most of the items were my own personal belongings. So paypal held my funds for 6 months and it was a horrible experience. After this, I decided to use a credit card merchant account instead of going through paypal. To your other question, I have order processed my customer’s order, they have already gone through the checkout system and paid. So after they’ve paid, my merchant should give me the money by depositing to my bank. But since my merchant acct has been suspended, of course the answer is no deposit, "but you still have to ship"
To you next question: Okay, Everything seemed fine, but then I realized that funds were not being deposited from my credit card merchant and I find out yet again that my account is on hold for some time for review (the holdup being due to chargebacks from several customers). Those chargebacks were looked into and I realized that they were from people that had used stolen credit cards. So cell phones were shipped out and chargebacks were done. My merchant concluded me as a high risk account, that’s why they suspended me. (thanks to those fraudulant credit card customers of course)

I had someone pull a fast fraud with me on ebay and they (ebay secruity) asked for the headers from person but I do not know how to get headers-trailers from my yahoo mail–there is just the email address. I NEED headers..We have to protect each other out here in cyberland..Thanks for your help..Remember I am computer illeterate..Need simple Directions..thanks agin

How much trouble is my son in?

Hi,

My son got some expensive software legally. He then decided to put it on ebay for sale, and sold to a man in netherlands for around £1000. (Was paid for in January 2008).

The buyer apparantly hasn’t been happy with it for a while now, and apparantly he thinks the software is not genuine, but offers no evidence of why. I assume he is also saying the goods are not as described.

He is demanding a full refund, but my son has no money, and on principle, I am not sorting this one out. My son is under 18.

Things that may affect this:

1. Was originally sold on ebay, but my son agreed to withdraw the auction for a better price from the buyer. So not sure whether this transaction counts as an auction. My son shouldn’t have been allowed an eBay account anyway.

2. This happened 10months ago, and the buyer took no action, i.e. Trading Standards/Legal etc…

3. My son has no money/property.

4. As this is computer software, I would assume the buyer has installed it, therefore a refund would not usually be made anyway, in a shop anyway?

We’re from the UK, and would really like some advice. Can he be sued, arrested, (fraud or something?), etc?

Best way to proceed?

ok so i brought some poker chips off someone over the internet last night and they ripped me off. they advertised the poker chips on ebay, they cost me 0 for 150 million i payed him and he didn’t give me the chips. i have called him many times and he just hangs up on me i have also sent him e-mails to give me my money or the chips but he wont he has just blocked me and wont respond to my calls or emails he has done this to 1 other person as well…
so what i want to know is what can i do to get my money or the chips i have payed for? can he get into trouble for this because it is fraud and he just ripped me off?? what can i do to get him into trouble or even just to get my money back ??? could i take legal proceedings against him for fraud ie: court or even get the police to do anything about it. i live in south australia and he lives in nsw australia
any advice is Very much appreciated thanks…

ps – i know it was dumb to buy them over the internet and if i could do it all over again i wouldn’t of brought them it is the first time i have done it. my friend has done it before and she really did get her poker chips but HONESTLY what can i do to get my money back 0

Taking legal action against ebay member?

I had a problem with an ebay member who didn’t like the way an item I was selling was titled.She reported it to ebay and the item was removed and revised and relisted.The item sold and the problem person emailed the buyer and gave him emails between the two of us and other shady info.The buyer filed a claim on paypal and lied in his dispute which I can proove..Now she has apparently emailed another buyer and he is refusing to pay for an item he won.She has never bought anything from me and has never seen the item in question.She has called me a liar and a fraud and is trying to damage my character with this personal vendetta.Any advice would be appreciated.

A fraudalent ebay seller recently took over ,000, did not ship the purchased items and will not refund the money. And there is plenty of documentation to prove these charges. Yet, Ohio law enforcement officials will do nothing. Absolutely nothing to bring this fraudalent scam artist to justice. It falls upon the victims (2 in this instance) to travel to Ohio and go to the legal expense of civil litigation to receive any kind of justice. If you live in Ohio, go ahead and scam the out-of-state public all you want. Chances are you will get by with it with no repercussions. My advice to anyone shopping on ebay is Don't Buy From An Ohio Seller! You might get taken and have no recourse for restitution except through your own very great expense!

I’m In A Legal Bind, Need Advice.?

I have a warrent for my arrest in the state of Illinois. It resulted from an ebay auction that I didn't make good on. The charge is wire fraud. I've never actually been to Illinois, however when I get pulled over by cops they inform me that I have a warrent but its non-extraditable from where I live at currently.

Apparently as long as I stay away from Illinois and its surrounding states I have nothing to worry about.

Still, I don't like this and would like to face the charge. I figure I'd just take some cash with me for bail money and take a trip to Illinois and turn myself in, while obtaining a lawyer in that area of course.

I've never been in trouble like this so I'm wondering what can i expect, also I'm kinda leaning toward never going to Illinois and just knowing that I'm wanted in that state.

Tax fraud suspicion. Need advice.?

I know of a Corporation that is purchasing a product from another country. He imports said product and resells nationwide. Recently he created several DBA’s under the same Corporation and has started selling said product, at a hugely inflated price, to one of his DBA’s. He then dumps said product on Ebay at a huge loss (but at a loss greater than what he purchased from originally overseas). Can anyone explain what he is doing and tell me if it’s “legal”? Is he trying to create a loss on paper while actually making a profit? He has created 3 such DBA’s that he uses to push his product on Ebay.

Fraud Legal advice needed?

I recently sold a gift card on ebay for 102 dollars and it turns out that the person who bought it from me was using someone elses account illegally. With the person's account, the thief purchased my item and ran. Once the person suffering from identity theft realized 102 was missing, she contacted paypal and got her money refunded from me even though I had already withdrawn it. So, I am down 102 dollars with nowhere to turn. What do I need to do to file a policie report in this situation because technically the theif and the victim got what they wanted and I am down 102 dollars. I technically had my item stolen from me. The item was a gift card and Nike.com has the person's address on file from the purchases they made with my card, but because of privacy issues, neither me nor paypal can get the address from them. What steps should I take to get the police to investigate this and get the address so they can bust the person?
