What will happen What should he do?

My husband mistakingly accepted unemployment until his first paycheck, unaware of it being wrong. He has a court date monday and not enough time for a lawyer. Does anyone know what will happen? I heard fraud, messed up credit? But is there ANY way to avoid this if it was a misunderstanding?
